The Regular Meeting of City Council was held in the Council Chamber, City Hall, 200 Craig Street, Duncan, BC at 7:40 p.m., April 28, 2003. Present: Mayor Michael Coleman; Councillors Mike Caljouw, Jenny Farkas, Phil Kent, Geoff Maxwell and Ken Newcomb. Absent With Prior Notice: Councillor Sharon Jackson. Also Present: Paul Douville, City Administrator.
	His Worship Mayor Michael Coleman opened the Council Meeting with a prayer and called for order.
Adoption of Minutes	Movd. Councillor M. Caljouw Secd. Councillor G. Maxwell THAT the minutes of the Development Permit Hearing and Regular Meeting of City Council held on April 14, 2003 be adopted. Carried.
	Communications:
Move For Health Day	Movd. Councillor P. Kent Secd. Councillor K. Newcomb THAT the Council of the City of Duncan proclaim May 10, 2003 as "MOVE FOR HEALTH DAY" in the City of Duncan as requested in the April 7, 2003 letter from various organizations promoting physical activity in BC. Carried.
Elk Creek Rainforest	Movd. Councillor P. Kent Secd. Councillor G. Maxwell THAT the letter dated April 7, 2003 from the Western Canada Wilderness Committee be forwarded to the Minister of Forests, Hon. Mike de Jong, requesting that his Ministry Officials provide information regarding the issue of the Elk Creek Rainforest to the Council of the City of Duncan for their further consideration. Carried.
National Missing Children's Day	Movd. Councillor M. Caljouw Secd. Councillor K. Newcomb THAT the Council of the City of Duncan proclaim May 25, 2003 as "NATIONAL MISSING CHILDREN'S DAY" in the City of Duncan; AND THAT the Council of the City of Duncan authorize Child Find British Columbia to conduct a fundraising canvass in the City of Duncan during May 2003 as requested in the April 9, 2003 letter from the Executive Director of Child Find BC. Falun Dafa Week	Movd. Councillor M. Caljouw Secd. Councillor J. Farkas THAT the Council of the City of Duncan proclaim May 12 - 19, 2003 as "Falun Dafa Week" as requested in the April 19, 2003 letter from Jane Banks on behalf of Falun Dafa Association of Canada, Victoria Group, noting that at the core of Falun Dafa are the principles of truthfulness, compassion and forbearance. Carried.
BC Children's Hospital Donation – Hot Dog Sales	Movd. Councillor G. Maxwell Secd. Councillor P. Kent THAT the Council of the City of Duncan authorize the Duncan Branch of the CIBC to hold a hot dog sale on the sidewalk immediately in front of the branch (116 Station Street) on Friday, May 9 & 23, 2003 with the proceeds of the sale to be donated to the BC Children's Hospital. Carried.

	Junior Council Meeting
	For consideration was a letter dated April 15, 2003 from the City Administrator regarding items from the April 10, 2003 Junior Council Meeting.
Coronation @ TCH - Right-Turn	Movd. Councillor P. Kent Secd. Councillor K. Newcomb THAT the Junior Council resolution, regarding a right-turn lane for east-bound traffic on Coronation Avenue at the Trans Canada Highway, be referred to the Planning & Priorities Committee. Carried.
Council Chambers – Redecorating	Movd. Councillor G. Maxwell Secd. Councillor K. Newcomb THAT the Junior Council resolution, regarding redecorating of the Council Chambers, be referred to the Public Works Committee. Carried.
	Totem Poles Committee
	For consideration were the notes of the April 23, 2003 meeting.
Totems Proposed for City Square	Movd. Councillor G. Maxwell Secd. Councillor P. Kent THAT the following April 9, 2003 Totem Pole Committee recommendation adopted by City Council at the April 14, 2003 regular Council meeting be rescinded: "THAT the Harvey Alphonse and Kelly Antoine totem pole, donated by the Cowichan Tribes to commemorate the Totem Project (Eagle Above Whale Holding Calf (4m (14') high), be located next to the west wall of Gallowglass Books in the City Square parking lot; AND THAT this totem pole face in a south-west direction." AND THAT City Council be requested to postpone the placement of any totems in City Square until the Totem Committee develops an overall totem plan. Carried.
	Councillor Maxwell advised that the proposed 2 totem poles for the City Square would cost approximately $3,000.00 per pole to relocate.
Miscellaneous	Councillor Newcomb reported on the following items: · With Councillor Maxwell, he attended a recent meeting of the Cowichan Community Centre Commission regarding the proposed new library. It has been reported that all tenders were high and that BCBC is reviewing the tenders and will be reporting back to the Commission in 3 weeks time. · He and a number of members of Council and the Administrator participated in a tour of the Cowichan Valley Museum at the Railway Station on April 16, 2003. He said the tour was most interesting and enlightening and those who attended recognize that the Museum is definitely in need of more storage space and in the long-term, a fire proof structure. · The Economic Development Commission will be holding a public Open House at the Quw'utsun Cultural Centre regarding the new branding program between 6 and 8 p.m. on Wednesday, April 30, 2003.
	Mayor Coleman reported on the April 23, 2003 Cowichan Valley Arts Council Spring Show. He said it was an excellent show with many excellent pieces of art displayed and sold.

Kent THAT Council appoint the following Parking Management Advisory Committee members: 1. Councillor Jenny Farkas 2. DBIAS Representative – Laurie Friesinger 3. APC Representative – Tracey King 4. 271 Campbell Road – Development Variance Permit	Movd. Councillor G. Maxwell Secd. Councillor K. Newcomb THAT the Council of the City of Duncan support the Development Variance Permit related to the proposed Bare Land Strata Title Subdivision for 271 Campbell Road on the following basis: The existing dwelling to abut the common property area The minimum side-yard setback to be 0.0 metres rather than the required 1.5 metres (5') The south side eave of the existing dwelling to encroach into the Common Property. Carried.

	New Business:
Craig Street Bricks	It was reported that the repair of the Craig Street bricks between Kenneth and Ingram Streets will proceed from April 29 to May 2, 2003. The subsurface is being replaced with a binding compound and all the bricks are being relayed. The Administrator was asked to provide information on the work performed by City crews since the City Square project was completed to keep the brick surfaces safe.
Special Council Meeting	Movd. Councillor M. Caljouw Secd. Councillor G. Maxwell THAT the Council of the City of Duncan resolve into Special Meeting (Committee of the Whole) to discuss legal issues; AND THAT persons other than Council Members and the City Administrator be excluded from this meeting (Section 242.3 – Local Government Act). Carried.
