Delegations
Human Resource Centre for Students
Representing the Human Resource Centre for Students, Laura Aitken addressed Council. She introduced her co-worker Sarah Morden. Ms. Aitken advised that the Human Resource Centre for Students has opened its doors for summer at 103 - 80 Station Street (Cowichan Merchants Building). This youth employment strategy is federally funded and has been in operation for 30 years. The concept is a peer-group service where students assist students in finding jobs. The target clientele is 15 - 29 years of age and all students.
Ms. Aitken listed the types of casual employment that they locate and fill with the students. The Student Employment Officers visit local High Schools and provide group information services to all interested students. The goal is to provide quality job experience that students can use in resumes for future job searches.

RCMP Report
Representing the North Cowichan/Duncan RCMP Detachment, S/Sgt. Howard Goodridge addressed Council regarding the lengthy Review Report provided by Inspector Linton Robinson. Inspector Robinson would have made this presentation but he was called out-of-town for this date.
S/Sgt. Goodridge reviewed the highlights of the Report and noted in particular the following items:
* The overall Criminal Code Offences reported in the fourth quarter of 1999 under Duncan Provincial, which would include the City of Duncan, has decreased.
* One area that did not decrease is in B & E's (33 in the first quarter of 2000 compared to 20 for the same period in 1999).
* 1/2 of all offences are "property" offences.
* There are 5 Counter-Attack Programs every 2 weeks (15 charges laid to-date in 2000).
* They have a very active Victim Services Program (74 referrals in March and 118 in April).
* On March 21, 2000, the Detachment established a 2-person plainclothes "street crew". The main mandate is to deal with property offences (i.e. break & enters/ thefts from vehicles/theft of vehicles).
* The Detachment has established 1 of their members who has acquired additional training in the area of forensic identification. This member is available to assist their General DD/Plainclothes Units with fingerprinting scenes of crimes and/or property. The purpose of setting up this member was to offset the time restrictions in having a member brought from their Forensic Identification Unit in Nanaimo.
* Major crime scenes will still be dealt with by their Forensic Identification Unit in Nanaimo.
* The S/Sgt. reviewed the March 2000 crime prevention report submitted by Cst. Tracy Rooke, which shows a very active program.
* In the Auxiliary Policing Report, they refute misinformation being circulated by the Auxiliary/Reserve Peace Officer Association (ARPOA). This Association is not affiliated with the RCMP nor are even a significant number of the Auxiliary Constable members of this Association.
* Currently there are approximately 552 appointed active auxiliaries who are committed to the program (we have 5 locally). This number compares favourably with the active auxiliaries in 1997 prior to the disarming of auxiliary constables being implemented.
* For Human Resources, the overall RCMP budget has increased $1.9 billion to $2.4 billion. By the end of March 2001, all contract positions will be filled.
* 1,200 cadets will be sent to their training academy at Depot Division. Our local detachment will be acquiring 2 cadets in the near future.
S/Sgt. Goodridge then answered questions from Members of Council and he was thanked for his presentation and he left the meeting.
Bill Routley - IWA
Representing the Industrial, Wood & Allied Workers' of Canada (IWA), President of Local 1-80, CLC President Bill Routley addressed Council. With approximately 130 IWA Union Members present, Mr. Routley asked for Council's support in attempting to save the Youbou Sawmill.
TimberWest has entered into exclusive negotiations to sell the Mill and transfer Tree Farm License (TFL) 46 to Vancouver-based J.S. Jones, which wants to close the mill and relocate roughly 80 employees to the CIPA Mill in Nanaimo that it is also planning to purchase. TimberWest would keep the $10 million property the Mill sits on as a real estate holding for future development.
Mr. Routley told Council about discrepancies in TimberWest's 1998 and 1999 Reports compared to what the Company is saying now that it wants to close the Mill. In the 1998 and 1999 reports, they touted the Youbou Sawmill as a Company asset that is one of very few Mills in North America that is very flexible to accommodate customer demand and that can produce long length timber needed in bridge building and other massive projects.
TimberWest is the largest owner of private forestlands in British Columbia. Apparently, TimberWest is intent on increasing the activity of its newly formed real estate business, no matter what effect that has on jobs in the forest sector. This includes identifying properties where the real estate value potential exceeds the value of continued timber production. In their annual report, they state they are preparing for when the real estate market picks up again on Vancouver Island.
Mr. Routley told Council that TimberWest's raw log exports increased by 85% in 1999 to a grand total of 837,000 cubic metres. The Company plans to export more than 1,000,000 cubic metres of raw logs in 2000.
Mr. Routley said that the Youbou Sawmill is on private property and so the Company can do what it wants. The only option left to the Union and the public is to try to stop the transfer of the TFL and cut down on log exports. If the Province approves the sale and the TFL transfer, J.S. Jones would use the wood supply from TFL 46 to feed the CIPA Mill in Nanaimo that lacks a steady timber supply. TimberWest is attempting to call the proposed transfer of 80 Youbou employees to CIPA a "Mill relocation" in hopes of circumventing the TFL's requirement to feed the Youbou Mill with approximately 350,000 cubic metres of timber per year.
Mr. Routley noted that in 1995, the Youbou Sawmill lost $8.7 million but in 1998, they saw a $1 million profit and a $2.4 million was projected for the year 2000. In 1998, TimberWest experienced a $68.5 million profit and in 1999, a $92.4 million profit. The capital expenditures at the Youbou Sawmill were only $7 million in 1998 and $6.6 million in 1999.

THAT the Council of the City of Duncan correspond with the Provincial Minister of Forests, the Honourable Jim Doyle, with copies to IWA Canada Local 1-80, advising that we are strongly opposed to any proposal to sell and close the Cowichan Lumber Mill at Youbou, BC; AND THAT further should TimberWest attempt to transfer TFL 46, Council is opposed to the transfer as this would clearly be a violation of the social objectives of the Tree Farm License and would be detrimental to our community and region;
AND THAT since TimberWest has shown that they intend to dramatically increase the amounts of raw log exports leaving the Cowichan Valley at the same time as they are maneuvering to close the last large remaining Sawmill on Cowichan Lake, Council feels this would greatly negatively impact the communities of Lake Cowichan, Youbou, Mesachie Lake, Honeymoon Bay, Caycuse and the entire area, including the City of Duncan and the District of North Cowichan;
AND THAT since we do not simply wish to become a raw log export pipeline to create jobs in the United States and Japanese Mills, Council demands that the Federal Government of Canada through the Honourable Pierre Pettigrew, Minister of International Trade, take action to stop the erosion of BC and Canadian jobs.

H & M Brake Ltd.
- Notice on Title
Representing H & M Brake Ltd. at 462 Duncan Street, Mr. Brad Tomiuk and Mr. Danny Neal were present to discuss the issue of a possible notice on title for deficiencies with a wood frame addition to the rear of their building at 462 Duncan Street.
Mr. Dave Sanders, City Building Inspector addressed Council advising that the representatives of H & M Brake Ltd. have now applied for a Building Permit. He said he has explained the process of a Council Notice on Title to them. He said they are prepared to install a concrete block wall along the south boundary of the wood frame addition, but they would still need to have a Structural Engineer determine whether the concrete slab under the addition is capable of supporting the structure. It was noted that with the Notice on Title, a potential purchaser would be advised of the shortcomings, which would have to be corrected before any sale occurred.
Danny Neal addressed Council advising that the addition was built for storage and for the siting of their large air compressor. He said they have no concern that the building will fall down but do wish to do the right thing from a fire safety point of view. He said their business is doing well since they purchased it in October of 1999 and that they want to construct a large concrete addition in the not to distant future to replace the temporary structure that is concerning the City. Mr. Neal said that he and his partner agreed that a notice be filed on Title so that the deficiencies will be taken care of in due course.

THAT according to Section 700 of the BC Municipal Act, City Council adopt a resolution to File a Notice on Title of 462 Duncan Street (Lot 3, Block 1, Section 17, Range 6, Plan 854, LD45) in the Victoria Land Registry stating that:
a) a City Council resolution relating to that land has been made under Section 700 of the BC Municipal Act, and
b) further information about it may be inspected at the offices of the City of Duncan:
i) No foundation under rear wood framed building addition contrary to the BC Building Code;
ii) Inadequate fire resistance rating on south-side of this addition also contrary to the BC Building Code;
iii) No Site Plan provided and no Building Permit secured nor any required inspections completed.

Outdoor Church Service - McAdam Park

THAT as requested in the April 27, 2000 letter from the Christian Reformed Church of Duncan, Council authorize the Church to stage an outdoor service on the McAdam Park Sports Field from 7:00 p.m. to 8:30 p.m. on August 20, 2000 (set-up to commence at 4:00 p.m. and tear-down to be completed by 10:00 p.m.) and to use the concession and washrooms building subject to the following terms and conditions:
1. Payment of the $50.00 user fee.
2. Payment of a $300.00 damage deposit, which will be returned if the park and facilities are left in an undamaged and clean condition.
3. The volume of the electronic speakers is to be kept to a level that will not disturb residents in the vicinity and the speakers must face the Cowichan River.
4. Since 200 - 300 people are expected and parking is at a minimum at the park; a shuttle service from and to the Church parking lot be provided.
5. The Christian Reformed Church of Duncan holding harmless the City of Duncan from any and all possible liabilities claims.
6. The Church having the event covered by their public liability insurance policy

Municipal Leaders' Statement on Climate Change

WHEREAS 1990 to 1999 was the warmest decade of the millennium;
AND WHEREAS a global reduction in emissions of greenhouse gases (GHG) is necessary to slow climate change and reduce the risks to human health, the physical environment, economy and quality of life;
AND WHEREAS the 1998 ice storm cost the City of Montreal $116 million; Baie Comeau more than $2.5 million, and the Regional Municipality of Ottawa-Carleton $6.32 million, while the Red River flood cost Winnipeg $32.3 million;
AND WHEREAS these weather-related expenses are creating an additional financial burden for municipalities at a time when responsibilities are increasing as a result of devolution;
AND WHEREAS reducing greenhouse gases makes good economic sense where new and improved infrastructure, energy efficiency, building retrofits, water conservation, more effective wastewater treatment and distribution, renewable energy technologies, waste reduction, better fleet management, etc., reduce municipal operating costs and help maintain community services, while having a positive impact on the environment;
AND WHEREAS industrialized countries, realizing initial commitments were inadequate to protect the Earth's climate system, agreed in December 1997 to the Kyoto Protocol which, if ratified, commits Canada to reducing its greenhouse gas emissions six per cent below 1990 levels between 2008 - 2012;
AND WHEREAS in November, national governments will meet in The Hague, Netherlands to negotiate terms and conditions for ratifying the Kyoto Protocol and it is critical that Canada has the support it needs to conclude negotiations;
AND WHEREAS Mayors and municipal leaders responsible for the well being of communities across Canada urge federal and provincial/territorial governments to make climate protection a priority;
THEREFORE BE IT RESOLVED THAT the City of Duncan endorse this Municipal Leaders' Resolution on Climate Change.

Public Works Committee
Sewage Lagoons
Councillor Caljouw advised that the $4 million upgrade work at the lagoons will be completed by May 26, 2000. Baffles have been installed to eliminate the humming noise that has been emanating from the new blower building. The phosphate foam in cell #1 should be eliminating as more solids are added to the cell. The Engineers may have to use chemicals to eliminate this problem. The odour that is emanating on occasion from the new system is likely caused by septage being illegally dumped into the system from manholes unknown. Councillor Caljouw asked members of the public to exercise due diligence and report any illegal dumping to City Hall or the District of North Cowichan Hall. Councillor Caljouw also added that landscaping of the project will be discussed at the upcoming Joint Utilities Board meeting.
Planning Committee

7-Eleven Convenience Store/Gas Bar - 1006 Government St.

THAT for the new proposed 7-Eleven Convenience Store/Gas Bar at 1006 Government Street, Council approve of the following variances:
* The exterior side-yard setback along College Street be reduced from 4.5 m (14.76 ft) to .5 m (1.64 ft) to accommodate the existing gas bar canopy overhang.
* The rear-yard setback be reduced from 4.5 m (14.76 ft) to 3.97 m (13 ft);
AND THAT the following provisions also apply:
* One of the parking spaces shown on their plan to be enlarged and designated as a loading zone (3m x 9m)
* A minimum 1.5 metre high decorative fence to be provided on property lines adjoining the residential zoned properties (west and north property lines; there is an existing fence on the west property line)
* A 6.1 metre (20 feet) wide strip of property adjoining and running parallel with Government Street be designated by a covenant as a no-build area to allow for future road widening.

Councillor Jackson advised that she has completed a research of various Advisory Planning Commission Bylaws and that the draft Bylaw will be presented to the Planning Committee for full review. All members of Council will be invited to attend.
Fire Services Agreement - Cowichan Tribes
For consideration was a memorandum dated May 18, 2000 from the City Administrator. The definition of "fire suppression" now clarifies that it includes life safety, property protection and overhaul to ensure fires remain extinguished. The Administrator was asked to discuss payment for extinguishing and suppressing brush fires with the District of North Cowichan and incorporate their provisions into their Agreement.

Rick Barry - Retirement
Councillor Caljouw reported that he and the Mayor and a number of Members of Council along with the Administrator attended the recent retirement party for Rick Barry, a volunteer firefighter for 24 years. A set of golf clubs was presented to Mr. Barry as a retirement gift and an indication of much appreciation.

Councillor Caljouw reported on the following items:
* He recently attended the Cancer Society Luncheon at the Moose Lodge at which time it was announced that they have successfully raised $165,000.
* He attended the Knights of Pythias Annual General Meeting and met delegates from all over North America.
* He participated in the recent McHappy Day.
* With the Mayor and Councillors Kent and Maxwell, he attended the opening reception of the Tourism Association of Vancouver Island Annual General Meeting being staged in Duncan.
* The Heart & Stroke Foundation Big Bike Ride endeavour recently raised $19,357.00.
Councillor Maxwell advised that he attended the Cowichan Tribes Potlatch 2000, which was co-hosted by Alexander School. He said it was very entertaining and enlightening.
Councillor Jackson reported on the following items:
* She said the provision of a CATSCAN unit at the Cowichan District Hospital may become a reality with the recent high prioritization of the unit by the Central VI Health Region.
* She attended the TAVI banquet last week at which time Judy Hill was awarded the Ina Mitchell Tourism Award.
* She attended the Thorne family honouring of their elders and presented a most welcomed gift from the City.
* The PowWow Totem is now complete and bids are being garnered through the Internet.
Mayor Coleman reported on the following items:
* He participated in two events during the recent Knights of Pythias AGM in Duncan.
* On May 13, he participated in the Forest Week opening activities.
* On May 14, he participated in the Royal Canadian Legion VE-Day Ceremony at Mt. View Cemetery.
* He participated in the recent BC 2000 Millennium Tour Kick-off.
* On May 18, he participated at the ribbon cutting ceremony for the Hire a Student office, then a Community Futures function and the Junior Council dinner.
* On May 29, the Eastern Star Organization will meet in Duncan and on June 8 the Eagles will commence their meeting in Duncan.
Councillor Moon reported that the Valley Link Cavalcade will start at the Duncan Mall at 7:00 a.m. on May 28 and travel via Lake Cowichan to Port Alberni through the proposed Valley Link Highway.
Councillor Moon also reported that along with Councillor Kent and Councillor Ridgway of North Cowichan, they selected the winners of the Sports and Arts Scholarships, the Legacy of the 1987 BC Festival of the Arts and the 1991 BC Winter Games.

Christian Youth Rally - Charles Hoey Park

THAT as requested in the May 18, 2000 letter from Anne Muller, Council authorize the staging of the Christian Youth Rally in Charles Hoey Park instead of Centennial Park from 6:30 p.m. to 9:00 p.m. on June 10, 2000 and to use the new Public Restrooms subject to the following terms and conditions:
1. Music and P.A. System volume must be kept at a reasonable level.
2. Volume will be reduced if a request is received from a resident in the vicinity of Charles Hoey Park or City Officials.
3. Payment of a $300.00 damage deposit, which will be returned if the Park and facilities are left in an undamaged and clean condition.
4. The organizers of the event holding harmless the City of Duncan from any and all possible liability claims related to the event.
5. The organizers arrange for a minimum public liability insurance coverage of $1,000,000. for the event and that a copy of the policy be provided to the City Administrator.

City Hall Exterior Painting
For consideration was a memo dated May 18, 2000 from the City Administrator and the contract proposal dated May 15, 2000 from J.R. Painting.

THAT Council accept the $6,250.00 tender from J.R. Painting (J.H. Boone) of Duncan to prepare and repaint all exterior painted surfaces on City Hall subject to compliance with all the terms and conditions outlined in the April 26, 2000 Invitation to Tender (e.g. work to be completed by June 30, 2000).

2003/2005 BC Seniors' Games
For consideration was a memorandum dated May 19, 2000 from the Administrator of the District of North Cowichan.
It was noted that the BC Games Society will be considering applications to host both the 2003 and 2004 BC Seniors' Games at the same time. The previous resolution of the Joint Councils only referenced 2003.
